Albuquerque, NM – Man charged with raping 4-year-old girl FREE TO GO under NM Bail Reform

Adam Lowther

Adam Lowther, 41, of Albuquerque, is a freed man despite his arrested for the rape of a 4-year-old girl according to a news release by the Bernalillo County Sheriff’s Office.

Lowther has been charged with first-degree criminal sexual penetration of a child under 13 and two counts of criminal sexual contact with a minor.

According to the pretrial detention motion that was filed, the victim alerted a teacher who then notified authorities. During the investigation, that included a forensic interview and physical exam, authorities arrested and charged Lowther.

At Lowther’s detention hearing before Judge Loveless, Lowther was released and FREE TO GO under under NM Bail Reform after the Arnold Foundation’s “Pretrial Risk Assessment”

Judge Brett Rogers Loveless

tool determined that he was not a danger to the community or a flight risk and therefore should not be subject to any accountable release – just a “promise” to appear.

The release is the result of newly enacted Supreme Court guidelines orchestrated by Chief Justice Daniels that virtually eliminates accountable pretrial release and bail.

(reported by Albuquerque Journal – Sept 2 2017)

The director of the Air Force’s School for Advanced Nuclear Deterrence Studies on Kirtland Air Force Base has been charged in the rape of a 4-year-old girl, according to a news release from the Bernalillo County Sheriff’s Office.

Adam Lowther, 41, was arrested and charged Wednesday with one count of first-degree criminal sexual penetration of a child under 13 and two counts of criminal sexual contact with a minor. He was booked into the Metropolitan Detention Center, where he remained Saturday.

According to a motion for pretrial detention filed in the 2nd Judicial District Court, the victim told a teacher about the abuse soon after the incident occurred.

The sheriff’s office responded after being asked for assistance by state investigators.

A forensic interview and physical exam revealed evidence of abuse, the sheriff’s office said.

James Fisher, a spokesman for Kirtland Air Force Base, confirmed the arrest and Lowther’s identity.

Fisher said Lowther, a civilian, did not live on base. Fisher did not know where the alleged abuse occurred.
