Family: Charges and bond too lenient for suspect accused of near-deadly hit and run

Absolute disbelief — that’s how a family describes what they call lenient charges and bond for a man accused of drunkenly running a woman over not once, but twice, in her own driveway.

”People who have done much less seem to be more severely handled by the law,” said Dennis Montoya. “So we don’t understand.”

Montoya said more than two weeks ago, his sister-in-law Laura Montoya was severely injured. He said she was just saying goodbye to her granddaughter in her driveway when a car plowed into her, then left her for dead.

Police said when they caught up with the suspect five hours later after he fled the scene, a breathalyzer test showed he was twice the legal limit.  

The man accused of causing it all is 45 Darren Kitseallyboy. He pleaded not guilty Friday to charges of careless driving and leaving the scene of an accident with injuries.

While disgusted at the fact he pleaded guilty, family members said it wasn’t as bad as the moment Judge Jaqueline Flores changed his bond from $50,000 cash or surety to $500 cash only.

The reason why? His attorney told the judge Kitseallyboy couldn’t afford any bond.

“None of us have the money to pay the hundreds of thousands of dollars that it’s going to cost for her medical bills,” said Laura’s husband.
